2024 CMS Final Rule

Primary Care or Behavioral Health Providers’ Terminations

Beginning January 1, 2024, for contract terminations that involve a primary care or behavioral health provider, health plans must provide written notice via U.S. mail and make one attempt at telephonic notice at least 45 calendar days before the termination effective date to all patients who are currently assigned to that provider and to patients of that provider within the past three years.

Other Providers’ Terminations

Beginning January 1, 2024, for contract terminations that involve a specialty type other than primary care or behavioral health provider, health plans must provide written notice via U.S. mail at least 30 calendar days before the termination effective date to patients seen on a regular basis by the provider whose contract is terminating. 

Note: “Regular basis” means enrollees who are assigned to, currently receiving care from or have received care within the past three months.
